Even if you are tried in court, it is generally done by deliberation or mutual agreement. Moreover, human rights do not allow imprisonment just on the basis of not paying a debt. But if there are elements of Criminal Law such as identity fraud, documents, or you violate the terms of the agreement then you can be subject to sanctions or even imprisonment.

No, you cannot be arrested or sent to jail simply for having debt or failing to pay a debt in the United States. Here are some key points on debt and arrest laws:
– Debtors’ prisons are illegal – The U.S. Constitution prohibits jailing someone solely because they are unable to pay a debt. Debtors’ prisons were outlawed in the 1830s.
– Private debts – It is illegal to arrest someone over private consumer debt such as credit cards, medical bills, personal loans, etc. Creditors cannot have consumers jailed but can sue for repayment.
– Civil judgments – If sued for nonpayment and a court issues a civil judgment against you, failure to comply could result in wage garnishment, liens, or asset seizure but not arrest.
– Criminal non-support – Failure to pay court-ordered child support or alimony may result in penalties like wage garnishment but typically not jail. Criminal nonsupport charges are rare.
– Taxes – Not paying taxes is not grounds for arrest. However, tax evasion through fraud or deceit can carry criminal charges and potential jail time if convicted.
– Government debt – Not repaying government backed debts like federal student loans cannot result in incarceration. The government can pursue wage and asset seizure.
So while nonpayment of debts may carry serious financial consequences, private debt alone does not result in criminal charges or arrest in modern times. Certain fraud cases are exceptions.
