One man was arrested yesterday in my street because of overdue debt, according to story, this man went to someone profession shop to buy in credit, he bought food Worth 7k promising to pay in the coming week, it’s been 1 month now the man had not paid the money, yesterday he was arrested and I’m sure he’ll provide the money once he reach the station.

Owning debt isn’t that bad because our current world, thing’s isn’t financially stable, we may have today but lack tomorrow, but it’s better to provide a plan before getting into debt.

Yes I think one can actually arrest a defsulter that hasn’t paid up hod or her debt and is still stalling with payment. They are people that just want things done the hard way before the respond positively to a good cause. So In this case when there’s no other way out after asking the person to pay for a long time it would be time to get the person arrested. So people just need to be handled harshly to get ones money.

No, you cannot be arrested or sent to jail simply for having debt or failing to pay a debt in the United States. Here are some key points on debt and arrest laws:

    – Debtors’ prisons are illegal – The U.S. Constitution prohibits jailing someone solely because they are unable to pay a debt. Debtors’ prisons were outlawed in the 1830s.

    – Private debts – It is illegal to arrest someone over private consumer debt such as credit cards, medical bills, personal loans, etc. Creditors cannot have consumers jailed but can sue for repayment.

    – Civil judgments – If sued for nonpayment and a court issues a civil judgment against you, failure to comply could result in wage garnishment, liens, or asset seizure but not arrest.

    – Criminal non-support – Failure to pay court-ordered child support or alimony may result in penalties like wage garnishment but typically not jail. Criminal nonsupport charges are rare.

    – Taxes – Not paying taxes is not grounds for arrest. However, tax evasion through fraud or deceit can carry criminal charges and potential jail time if convicted.

    – Government debt – Not repaying government backed debts like federal student loans cannot result in incarceration. The government can pursue wage and asset seizure.

So while nonpayment of debts may carry serious financial consequences, private debt alone does not result in criminal charges or arrest in modern times. Certain fraud cases are exceptions.

I was so shock, I wasn’t believe financial bank can do that, I was thinking maybe they will just take my in-law property in place of that debts that all.

It’s always good to settle debts immediately you received your salary or you activate for automatic deduction so that bank can deduct their money regularly.

In many countries, you generally cannot be arrested solely for owing money or being in debt. However, there may be legal consequences if you fail to meet your financial obligations, such as not paying taxes, child support, or ignoring court orders related to your debts. These consequences typically involve civil actions like wage garnishment, asset seizure, or lawsuits. It’s important to consult with a legal professional if you have concerns about your specific financial situation to understand your rights and responsibilities. Laws can vary by jurisdiction, so it’s essential to seek local legal advice.

In fact, debts and receivables are included in the realm of Civil Law so there are no regulations for arresting and imprisoning you if you don’t pay your debts. Even if you are tried in court, it is generally done by deliberation or mutual agreement. Moreover, human rights do not allow imprisonment just on the basis of not paying a debt. But if there are elements of Criminal Law such as identity fraud, documents, or you violate the terms of the agreement then you can be subject to sanctions or even imprisonment.
